Photograph the vehicle's condition and the location before it leaves if you are present, and photograph the signage or its absence, since inadequate signage is among the most common grounds for challenging a private-property tow.

If you believe the tow was improper, pay under protest and dispute afterward rather than leaving the vehicle to accumulate daily storage charges, which escalate quickly and can eventually lead to a lien sale of the car. Get an itemized bill listing every charge. Then file complaints with the state agency regulating towing, which is often the department of motor vehicles, transportation, or consumer affairs, and with the municipality if a local ordinance applies. Small claims court is a realistic venue for recovering an improper fee and for damage claims, since towing damage to bumpers, transmissions, and undercarriages is common and the operator's insurance is the source of recovery.
