Different rules apply elsewhere. Genuine volunteers for nonprofit and public sector organizations may serve without pay in many circumstances, which is why unpaid positions are more common and more defensible there. State law can be stricter than federal law and several states apply tighter standards. For students weighing an offer, the equity concern is real and documented: unpaid internships systematically favor those who can afford to work without income, and research has found paid internships correlate with better job placement outcomes. If you believe an unpaid internship was misclassified, the Wage and Hour Division accepts complaints and back wages are recoverable.
