A homeowners association is a governing body created by covenants, conditions, and restrictions recorded against the property. Buying in means accepting them; there is no opt-out, and the obligations run with the land. The association collects dues to maintain common areas and shared amenities, and it enforces rules that can cover exterior paint colors, landscaping, fences, parking, rentals, pets, and satellite dishes. Powers vary by state and by the specific governing documents, but generally include levying fines, and in many jurisdictions placing a lien on your home for unpaid amounts and foreclosing on that lien.

Special assessments are the financial risk buyers most often overlook. When a major expense arrives, a roof replacement across a condominium complex, structural repairs, or a legal judgment, the association can assess owners for their share, and those amounts can reach tens of thousands of dollars with limited notice. The defense is examining the reserve study and the association's financial statements before you buy, since a chronically underfunded reserve is a reliable predictor of future assessments, and reviewing meeting minutes for the past year or two, which is where pending litigation and looming projects are discussed frankly.

What to read before closing, and most states give you a review period with a right to cancel. The covenants themselves, the bylaws, current rules and regulations, the budget, the reserve study, the last two years of meeting minutes, and any disclosure of pending litigation. Check the rental restrictions specifically if you might ever lease the property, since caps and outright bans are increasingly common and materially affect resale. Check whether the association is involved in litigation, which can make units difficult to finance. And know that disputes with an HOA are governed by the documents and state statute rather than general fairness, so the time to object to a rule is before you are bound by it.
