What is power of attorney, and who needs one?

A power of attorney authorizes a person you choose, called the agent or attorney-in-fact, to act on your behalf. The two common types cover different territory: a financial power of attorney handles banking, bills, property, and taxes, while a healthcare power of attorney, sometimes called a healthcare proxy, authorizes medical decisions if you cannot make them yourself. The word durable is the one that matters most, since a durable power of attorney remains effective after you become incapacitated, which is precisely the situation most people are trying to plan for. A springing power of attorney takes effect only on incapacity, which sounds appealing but can create delay while doctors certify the trigger.

Skipping this is the common and expensive mistake. Without a valid document, a family facing a sudden stroke or accident generally must petition a court for guardianship or conservatorship, a process that takes weeks or months, costs thousands in legal fees, becomes a matter of public record, and puts the decision of who controls your affairs in a judge's hands rather than yours. Marriage does not automatically confer these powers over separate accounts or medical decisions. Two practical cautions: a financial power of attorney grants substantial authority and should go to someone genuinely trustworthy, since abuse by agents is a recognized form of elder financial exploitation, and forms vary by state, so a document valid in one state may face resistance from institutions in another.
