Probate is the court-supervised process of proving a will is valid, paying the deceased person's debts and taxes, and distributing what remains. Duration varies widely by state and complexity, commonly running several months to over a year, and longer if anyone contests. Costs include court fees, executor compensation, and attorney fees, which in some states are set as a percentage of the estate's value rather than by hours worked. Probate files are public record, which means the inventory of assets and who received what becomes viewable by anyone, a fact that surprises most families.

Much property never enters probate if it is titled correctly, which is the practical lever. Retirement accounts, life insurance, and payable-on-death bank accounts pass directly to named beneficiaries, and those designations override whatever your will says, which is why an outdated beneficiary form is one of the most common and consequential estate mistakes. Jointly held property with right of survivorship passes to the co-owner. A revocable living trust holds assets outside the estate and transfers them privately without court involvement, which is the standard tool for avoiding probate, though it requires actually retitling assets into the trust, a step people frequently skip after paying for the document. Many states also offer simplified procedures for small estates. A will is still necessary regardless, both to direct anything left over and to name a guardian for minor children.
